1. Acceptance of Terms

By accessing or using the KWIKZA website and platform, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

KWIKZA provides a cloud-based business management and point-of-sale platform. We provide software tools to assist with billing, inventory, and automated communication. KWIKZA is a technology provider, not a bank or Non-Banking Financial Company (NBFC). We do not provide credit or financial services directly.

3. Account Registration & Responsibilities

You must provide accurate and complete information when creating an account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use & WhatsApp Compliance

When utilizing KWIKZA's WhatsApp automation and marketing features, you agree to comply strictly with Meta's Official Business and Commerce Policies.

• You must obtain necessary consent (opt-in) from your customers before sending them promotional messages.
• You agree not to use the platform to transmit spam, fraudulent, defamatory, or illegal content.
• KWIKZA reserves the right to suspend or terminate your account if you violate these communication standards or if your account is flagged by our API partners for abuse.

5. Subscription, Billing, and Payments

KWIKZA is a subscription-based service. You will be billed in advance on a recurring and periodic basis (monthly or annually). Your subscription will automatically renew under the exact same conditions unless you cancel it or KWIKZA cancels it.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall KWIKZA, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically under the jurisdiction of the courts in Pune, Maharashtra, without regard to its conflict of law provisions.
